Proposition
1. To approve the amendment of the transfrontier shipment of waste Ordinances in force in each island of the Bailiwick to –
(a) “freeze” the reference to EU Regulation (EC) No. 1013/2006 on shipments of waste, and other related EU legislation referred to in each of the Ordinances, to refer to that EU legislation as it had effect in the European Union immediately before the date of its repeal in the European Union, so as to avoid those Ordinances becoming unclear, and
(b) add a new regulation power so that changes can be made quickly to the Ordinances –
(i) to implement obligations extended to, or otherwise applying in, the Bailiwick under relevant international conventions or agreements relating to transfrontier shipment of waste, or
(ii) to be consistent with EU or UK legislation relating to transfrontier shipment of waste in view of waste shipments from the Bailiwick to the EU or the UK,
as further detailed in Section 4 of the policy letter.
2. To direct the preparation of such legislation as may be necessary to give effect to the above decision.
